City-Owned Garbage Truck Turning Onto Hudson Avenue at Warsaw Street Strikes and Kills a 75-Year-Old Man in a Motorized Wheelchair
ROCHESTER, NEW YORK (November 4, 2026) – A 75-year-old man was killed in a garbage truck accident at Hudson Avenue and Warsaw Street in Rochester.
Monroe County officials are saying that the crash occurred around 3:30 p.m. on Tuesday. A man was operating his motorized wheelchair on the west shoulder of Hudson Avenue when he was hit by a Rochester garbage truck that was traveling east on Warsaw Street.
One witness reported that the truck pinned the victim’s wheelchair. First responders were called to the scene of the accident to help the victim who was critically injured.
Sadly, he was pronounced deceased at the scene. Neither drugs nor alcohol appeared to have been factors in the crash.
Liability for Rochester Garbage Truck Accidents
New York law treats a person using a wheelchair as a pedestrian. Vehicle and Traffic Law § 130 defines a pedestrian as any person afoot or in a wheelchair, which means drivers owe wheelchair users the same protections they owe people walking. Drivers are expected to operate their vehicles with the due care necessary to avoid any person that is crossing an intersection on foot or in a wheelchair. This requires that they slow down and continuously scan their environment around them. Several issues should come under close review when examining responsibility for an accident involving a commercial truck.
- Turn Path: Commercial truck drivers are instructed to check the full path of any turn before initiating it.
- Blind Spots: Truck drivers should also keep in mind that their vehicles have large blind spots that can make pedestrians disappear.
- Fatigue: Managing fatigue is another important aspect of preventing pedestrian collisions.
- Crash History: When there is a history of collisions at a particular intersection, this may be indicative of a major issue with the safety infrastructure at that spot.
Liability for any accident involving a commercial truck could extend well beyond any specific driver determined to be at fault. One case that illustrates this well is Deleon v. New York City Sanitation Department. That case involved a person who was injured after their vehicle was hit by a street sweeper. The court ended up holding that the reckless disregard standard applied to the crash because the street sweeper was engaged in highway work at the time of the incident.
