New York Birth Injury LawyerAccording to the National Healthcare Quality Report (AHQR), out of every 1,000 infants born in the United States, 6 to 8 of them are born with some type of birth injury. In other words, approximately 1 in every 9,714 people is born with a birth injury in the U.S. To break it down even further, 28,000 people per year are born with a birth injury. Birth injuries are most common during deliveries that involve an instrument. Although not every birth injury occurs as a result of the negligence of a medical or healthcare professional, those that are enable the victim to seek compensation for their injuries.

These cases are complex and should only be handled by a law firm that specifically handles such medical malpractice claims. At Gersowitz Libo & Korek, P.C., our legal team has more than three decades of experience in handling all types of medical malpractice claims, especially birth injuries.

What Is a Birth Injury?

Birth-related medical malpractice occurs when a medical or healthcare professional fails to comply with the applicable standard of care while treating a pregnant woman and her child or treating potential parents for issues relating to procreation. There are three basic areas of birth-related medical malpractice: 1) injury to the mother and/or child during pregnancy or labor; 2) wrongful death; and 3) wrongful pregnancy.

Some common examples of mistakes or errors made by healthcare professionals that result in a birth injury include:

  • Delaying or failing to recognize the need for a Caesarean Section
  • Failing to detect an umbilical cord wrapped around the unborn child’s neck
  • Failing to attach enough significance to signs and symptoms of fetal distress
  • Failing to refer a woman with a high-risk pregnancy to a specialist
  • Failing to take necessary steps to avoid premature delivery
  • Failure to take appropriate precautions upon signs of oxygen deprivation to the fetus

If you believe that your child suffers signs related to a birth injury, you should consult with an attorney who can provide you with more guidance as to whether you have a viable medical malpractice. The seasoned birth injury attorneys at Gersowitz Libo & Korek, P.C. have the experience to help you determine whether you have a valid claim and help you obtain the full extent of the compensation you deserve.

Common Types of Birth Related Injuries Caused By Medical Malpractice

Birth injuries often occur when the infant is deprived of oxygen, causing brain damage. If a healthcare provider does not promptly deliver a baby who is in distress, or if a baby is not properly resuscitated after being born, there is a possibility that the resulting lack of oxygen will cause serious brain damage. Babies can also be injured when they are improperly delivered, or when they are not properly oxygenated during surgery.

Some common types of birth related injuries caused by medical malpractice include:

  • Cerebral Palsy – caused when blood flow, and therefore oxygen, is cut off from the brain for an extended period of time. Cerebral palsy is often the result of delaying a Caesarean section.
  • Shoulder Dystocia – occurs when the baby’s shoulder gets stuck on the mother’s pelvic bone. When resolved inappropriately by the doctor, shoulder dystocia causes brachial plexus palsy.
  • Brachial Plexus Palsy – caused by shoulder dystocia. Total brachial plexus palsy results in paralysis of the shoulder, arm, and hand.
  • Erb’s Palsy – a type of incomplete brachial plexus palsy that affects only the shoulder and upper arm.
  • Klumpke’s Palsy – a type of incomplete brachial plexus palsy that affects only the lower arm, wrist, and hand.
  • Birth Paralysis – can be caused by shoulder dystocia or cerebral palsy. May range from loss of sensation in one area of the body to quadriplegia, or loss of movement in all four limbs.
  • Spinal Cord Injuries – possibly the most severe type of birth injuries that can cause paralysis and neurologic problems. They often occur as a result of a traumatic nerve or cord damage or meningeal tear or the use of forceps.
  • Intracranial Hemorrhage or Subarachnoid Hemorrhage – an injury that involves bleeding in the skull, commonly under the two innermost layers of het brain covering.
