Pedestrian Killed in Bensonhurst Sanitation Truck Accident

A DSNY Dump Truck Turning at Cropsey Avenue and Bay Parkway Struck a Woman Who Reportedly Had the Light

NYC Roadway Where Accident or Crash Took Place

BENSONHURST, NEW YORK (November 3, 2026) – A 30-year-old pedestrian was killed in a sanitation truck accident at the intersection of Cropsey Avenue and Bay Parkway in Bensonhurst.

Kings County officials are saying that the crash took place around 6:35 PM on Wednesday evening. A woman was reportedly crossing Bay Parkway from Bensonhurst Park when she was hit by a sanitation truck that was heading east and turning right onto Bay Parkway.

The force of the impact knocked the victim to the ground and left her with severe trauma. First responders rushed to the scene of the collision and transported her to NYU Langone in Sunset Park to receive treatment.

The dump truck driver involved in the crash remained at the scene and cooperated with police. The intersection where the crash took place has a long history of reported crashes.

This includes an estimated 30 crashes in the year 2025 alone.

Liability for Bensonhurst Sanitation Truck Accidents

When a city vehicle strikes a pedestrian, New York law sets out both the driver’s duties and special rules for claims against the city. Under Vehicle and Traffic Law § 1146, every driver must exercise due care to avoid colliding with pedestrians. They are also required to slow down to avoid potentially colliding with any pedestrian in the roadway. If a city vehicle is involved, the municipality that owned that vehicle could potentially be held vicariously liable for any resulting damages. Several issues can help shape responsibility for these types of crashes.

  • Right-of-Way: Drivers are expected to yield to pedestrians that are crossing with the signal and in marked crosswalks.
  • Blind Spots: Large trucks have large blind spots. Their drivers must check these blind spots before initiating turns.
  • Driver Training: Agencies are expected to train and supervise operators of heavy vehicles given the inherent dangers to the public.
  • Telematics Data: Telematics data from fleet operators can reveal important details about the crash, including recorded speed and braking.

Dump truck collisions are often largely preventable. They tend to involve situations where drivers are not paying adequate attention to the road ahead of them. They may have been staring at their cell phone or fatigued from long working hours. Part of the problem is that many employers push their drivers to complete delivery routes as quickly as possible. This can lead drivers to adopt unsafe driving habits. The family of any person who died in a motor vehicle collision is able to seek some measure of accountability through a wrongful death claim.
