Pedestrian Injured in Woodgate Route 28 Accident

Mercy Flight Airlifts Pedestrian After Car Strikes Them at the Route 28 and Rogers Road Intersection in Woodgate

Pedestrian Died in Newark Car Accident By Thomas Street

WOODGATE, NEW YORK (November 4, 2026) – A pedestrian was seriously injured after being struck in a car accident at the intersection of Route 28 and Rogers Road in Woodgate.

Oneida County officials are saying that the accident occurred around 11:21 a.m. on Saturday. A car struck a pedestrian at the intersection for undetermined reasons.

First responders were called to the scene of the accident to help the victim. The pedestrian was transported by Mercy Flight to Upstate University Hospital with major injuries.

The driver involved in the crash remained at the scene and cooperated with officials. The corridor has seen numerous crashes before, including a fatal collision near Route 28 and Woodgate Road.

Liability for Woodgate Pedestrian Accidents

New York law places duties on both drivers and people on foot. Under Vehicle and Traffic Law § 1146, every driver must exercise due care to avoid colliding with a pedestrian on any roadway and must sound the horn when necessary. Drivers are also expected to operate their vehicles at a safe speed at all times. This may necessitate that drivers travel well below the stated speed limit, depending on the prevailing road and weather conditions. Responsibility for pedestrian collisions will typically turn on a number of key factors.

  • Scanning Ahead: Drivers are expected to scan the road ahead of them and take into consideration that pedestrians can be unpredictable.
  • Safe Speed: Drivers must regulate their speeds to take into account weather and factors beyond their control.
  • Visibility: Courts will also examine whether curves, vegetation, or other factors created visibility issues.
  • Evidence: Eyewitness statements and dash cam footage can also reveal how any collision took place.

Pedestrian accidents are highly complex events. The factors that contribute to any pedestrian collision could take place several hours or days beforehand. Legal responsibility for a pedestrian collision could extend to many different entities. This is particularly true if any vehicle was being used for some type of commercial purpose. Under New York law, employers are held vicariously liable for the negligent conduct of their workers who were operating within the course and scope of their job duties. Victims of pedestrian accidents are able to seek some measure of accountability through a personal injury claim.
