Exactech Knee Implant Failure Lawyers

Knee Implant FailureExactech has issued a recall for many of its polyethylene plastic inserts used in knee and ankle replacements. The recalled components fit in between metal casings and are used to cushion joints. They are used in the following knee and ankle replacements systems: Optetrak, Optetrak Logic, Truliant and Vantage. At issue is the packaging the inserts were distributed in. According to the company’s Urgent Medical Device Correction letter, the packaging for the inserts did not protect them from oxygen exposure.

Exposure to oxygen can degrade the inserts and lead to device failure. This may require recipients to need revision surgery down the road. Other problems that can occur may include bone loss and component cracking. Patients with these defective implants may experience bone loss, lysis, swelling, difficulty walking and pain at the implant site. Surgery as well as bone grafting may be needed to fix the underlying problems. If you were one of the estimated 147,732 people that received these devices since 2004, you may have recourse through a civil claim. The defective medical device attorneys at Gersowitz Libo & Korek, P.C. are here for you. They can evaluate your case free of cost and let you know if you have a legal claim that can be pursued. You can contact us at 800-529-9997.

Liability For Exactech Knee Implant Failures

All medical device companies have a legal responsibility to make sure that their products are reasonably safe. They must also take steps to warn about the non-obvious dangers associated with the use of their products. It is very expensive to bring a new product to market. Within the industry, there is always the temptation to cut corners in order to save money. Sadly, many medical device companies know about the potential dangers of their products and they fail to warn the public. When a company brings a product to market that is unreasonably dangerous, they could face liability through a civil claim. What follows below are some of the theories of liability Exactech could face for its defective products.

  • Plaintiff’s attorneys have argued that Exactech failed to warn consumers about the dangers of using their products and the deterioration that could occur over time.
  • Plaintiff’s attorneys have argued that Exactech’s products were packaged in such a way that made them susceptible to oxidation and unreasonably dangerous.
  • Plaintiff’s attorneys have argued that Exactech failed to conduct Post-PMA Clinical Studies about the long-term dangers associated with the use of their products.

This is not the first time that Exactech has face litigation over their products. Back in 2017, they faced a lawsuit for their OPTETRAK knee replacement system after it was discovered that those systems had an unusually high failure rate. Researchers have claimed that the less stringent safety approval methods of the 510(k) process may have contributed to unsafe Exactech products reaching the market. The odds of a recall were much lower for products cleared through the PMA process.

What To Do If Your Knee Implant Is Recalled

If you have had an Exactech knee implant, it is important that you seek medical advice as early as you can. Some of the medical problems associated with these device failures can be permanent and long lasting. They can also get worse over time. This is especially true for patients that are suffering from bone loss due to the implants. What follows below are some of the steps that you should take if you believe or suspect that your knee surgeon may have used one of Exactech’s products.

  • Collect all of the records that you can about your knee replacement surgery. This can include records about the first surgery that you had along with any revision surgery that you needed. Look to see if your surgeon used one of Exactech’s products.
  • Continue to follow all of the advice that you receive from your doctor. This could include potentially needing to undergo a revision surgery to remove and replace the implants.
  • Monitor all of the systems and problems that you have had with your knees post surgery. Take note if these symptoms get worse over time.
  • Speak with a lawyer as early as you can. Consultations with our team of highly experienced lawyers are completely free. We can answer all of the questions that you have about your knee replacement surgery.

Exactech has implemented a claim process for patients that received their defective implants. While this may seem like an attractive option, Exactech does not have your best interests in mind. Their interests are with their shareholders and to hold on to as much of their money as they can. Going through any claims process may also waive your right to file a product liability lawsuit against Exactech. Do not fill out any claim forms related to Exactech until you have had a chance to speak with legal counsel.
