Liability In Central Islip Truck Accidents
Thousands of people are killed or seriously injured every year in truck accidents. Driver fatigued is a major factor in a large number of truck accidents. According to Insurance Institute for Highway Safety (IIHS), “Drivers of large trucks are allowed by federal hours-of-service regulations to drive up to 11 hours at a stretch. Surveys indicate that many drivers violate the regulations and work longer than permitted.” There are a number of ways that commercial trucks can be particularly dangerous to pedestrians.
- Trucks have large blind spots that can often totally obscure the presence of pedestrians. These blind spots exist all around the truck and are especially pronounced in on the sides and back of the vehicle.
- Trucks can take 20 – 40% longer than passenger vehicles.
- Trucks are under near constant use and are prone to mechanical issues if they are not properly serviced.
Depending on the specific facts of any case, there could be numerous liable parties for a truck accident. Truck drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians. There is simply no excuse for ever backing into a pedestrian or pinning them against something. The vast majority of pedestrian accidents are totally preventable and are often due to driver error. If a truck driver can’t see what’s ahead or behind them, they should get out of their vehicle to check. There are a number of steps that should be taken after a truck accident.
- Photos of the accident should be taken.
- Surveillance footage should be sought.
- Eye witnesses should be interviewed.
- Medical records should be preserved.
The family of any victim that died in a truck accident may have legal recourse through N.Y. Est. Powers & Trusts Law § 5-4.1 (2021). Damages in a wrongful death claim can cover lost wages, medical bills and funeral expenses. Unfortunately, truck companies will often fight vigorously to deny liability for any truck accident. A truck accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
