Landscaper Dies in Accident After Falling From Truck in East Hills

OSHA Investigation Underway After Landscaper Died in Fall From Work Truck near Planting Field Road and Old Farm Road

Two People Injured In Staten Island Garbage Truck Accident

EAST HILLS, NEW YORK (September 14, 2026) – A landscaper tragically died in a workplace accident after falling from a truck in Nassau County near the intersection of Planting Field Road and Old Farm Road.

Nassau County officials are saying that the accident occurred around 2 PM on Thursday afternoon. The police received a call about a 35-year-old man who had fallen off of a landscaping truck and sustained major injuries in the process.

Paramedics were called to the scene of the collision to help the victim. Unfortunately, he was later pronounced deceased.

A full investigation remains ongoing at this time.

Liability for East Hills Landscaping Truck Accidents

Employers in New York have a legal obligation to maintain work sites in a reasonably safe condition. Pursuant to 29 U.S.C. § 654(a)(1), “(a) Each employer— (1) shall furnish to each of his employees employment and a place of employment which are free from recognized hazards that are causing or are likely to cause death or serious physical harm to his employees.” There are a number of factors that could contribute to any workplace fall.

  • Workers may not be provided with adequate fall protection.
  • Workers may be asked to perform work in an unsafe area.
  • Workers may not have properly been trained to assess fall risks.
  • Workers may be asked to perform their duties on a slick or otherwise unsafe surface.

When a worker is injured or killed in New York, they or their surviving family members will typically have recourse to the workers’ compensation system. This is a no-fault insurance scheme designed to help injured workers. An injured worker may also be able to pursue some measure of accountability through a third-party liability claim. A third-party liability claim may be possible if an entity separate from a worker’s employer contributes to an accident.
