New York truck accident | Holding Trucking Companies Liable

NEWSTEAD, NEW YORK (September 5, 2026) – One person has tragically died in a Newstead semi-truck accident along interstate 90.

New York State police are saying that the collision occurred around 2:30 AM on Friday morning. A 2018 Volvo tractor-trailer truck was traveling westbound on the interstate when it was involved in a collision with a disabled 2012 Chevrolet pickup truck that was along the right shoulder.

Paramedics were called to the scene of the collision to help the victim. A 62-year-old passenger of the pickup truck was transported to a local hospital in serious condition.

Unfortunately, a 61-year-old man was pronounced deceased at the scene.

Liability for Newstead Truck Accidents

Truck drivers have a legal obligation to use caution to avoid collisions with other vehicles. They must have obtained a commercial license and are held to a high standard in terms of safety. Under New York Vehicle and Traffic Law § 1144-a(d), drivers must exercise due care to avoid colliding with any vehicle that is parked along the shoulder of the highway. Several factors will be taken into consideration when evaluating who could be liable for any traffic collision.

  • The speed of the truck driver involved should be considered.
  • The positioning of the vehicle prior to the collision should also be reviewed.
  • Visibility conditions are also important to take into consideration.
  • It should be determined if the truck driver complied with all hours-of-service regulations.

If a truck driver fails to slow down to avoid colliding with a vehicle in their own lane of traffic, this could be construed as negligence. Depending on the unique facts of any case, several parties could potentially be liable for any truck accidents. For example, the employer that a truck driver was working for could be responsible. As a matter of law, employers in New York are legally responsible for the negligent actions of their workers who were operating within the scope of their job duties.
