Liability For New York City Car Accidents
Inclement weather is one of the major causes of car accidents. According to the U.S. Department of Transportation, “Most weather-related crashes occur on wet pavement and during rainfall. Each year, 75 percent of weather-related vehicle crashes occur on wet pavement and 47 percent happen during rainfall. Nearly 5,700 people are killed and more than 544,700 people are injured in crashes on wet pavement annually.” Drivers should take a number of actions in order to reduce accidents during rainfall.
- Drivers should reduce their speed and maintain a safe distance between themselves and the lead vehicle.
- Drivers should use their headlights to warn others about their presence.
- Drivers should check their tire conditions and ensure that their tires are well inflated.
- Drivers should be aware of the possibility of hydroplaning and what to do if their vehicle does hydroplane.
Speeding is one of the main causes of car accidents during rainfall. All drivers have a legal obligation to maintain their vehicle at a safe speed. During rainfall and other periods of inclement weather, drivers will need to operate their vehicle well below the posted speed limit. If a driver fails to slow down to avoid hitting another vehicle or pedestrian, this could form the basis of a negligence claim. Several steps should be taken after any car accident.
- Photos of the accident site should be taken.
- Surveillance footage should be sought.
- Medical records related to the accident should be collected.
- An experienced personal injury attorney should be contacted.
The vast majority of car accidents that happened during rainfall are preventable. They tend to involve drivers who are distracted, speeding, or otherwise following the lead vehicle too closely. There is a rebuttable presumption of negligence on the part of any driver that rear-ends a vehicle in their own lane of travel. Any person injured in a car accident may be able to seek some measure of accountability through a personal injury claim.
