New York’s Scaffold Law: The Critical Protection for Construction Workers

Construction remains one of the most inherently dangerous jobs in America. According to the Occupation Safety and Health Administration (OSHA), 20.3 percent of worker fatalities in 2013 were in construction. The leading cause of worker deaths on a construction site was falls, followed by struck by objects, electrocution and caught in-between. These are known as construction’s “Fatal Four.”

New York construction workers are no exception to this real danger. Despite the dangerous nature of their line of work, the workers in this state can be confident that if they are injured in an accident, the Scaffold Law will help them get the legal protection they deserve. Despite critical protection for thousands of construction workers across New York, the Scaffold Law remains the topic of many discussions in Albany.

Construction WorkersThe Fight Over New York’s Scaffold Law

For years, there has been dispute over New York’s century-old Scaffold Law. Big business and their lobbyists seek to weaken and even eradicate the Scaffold Law. Fortunately, these attempts have not been received by our Legislatures in Albany – and for good reason.

Despite the oppositions’ repeated exaggerations and mistruths, the Scaffold Law simply places responsibility where it belongs: on the people who need to ensure that their employees are provided with a safe work environment. If those who control the work site follow the law, contractors and owners cannot be held liable in court.

The Scaffold Law Works

As construction remains one of the most dangerous jobs in the country, New York had the nation’s sixth-lowest construction injury rate from 2000 to 2012. This is in part due to the effectiveness of the state’s Scaffold Law. Reforming or gutting the Scaffold law would eradicate an important safety incentive, ultimately leading to more worker injuries and fatalities.

Keeping the Scaffold Law strong is one of the most critical ways we can protect the numerous individuals who risk their lives every day to build New York’s infrastructure.
