Liability for Brooklyn Hit-and-Run Car Accidents
New York law requires all drivers to exercise due care to avoid colliding with any pedestrian or cyclist that they encounter. Pursuant to Vehicle and Traffic Law § 1146, “ every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” There are many factors that could contribute to any bicycle accident.
- Speeding: Drivers are more likely to be involved in collisions if they are speeding.
- Distraction: Drivers that hit cyclists are routinely distracted.
- Intoxication: A large portion of pedestrian collisions involve drivers that were intoxicated.
- Visibility: Pedestrian collisions routinely occur in the early morning and late evening hours when visibility is reduced.
When a driver fails to slow down to avoid colliding with a cyclist, this could be construed as negligence. Even if a cyclist or pedestrian is outside of a marked crosswalk, this does not remove a driver’s duty of care to avoid the crash. Any person injured due to the negligence of another driver in New York City may be able to pursue damages through a personal injury claim. Damages can help cover lost wages, medical bills, and pain and suffering.
