Liability for East Harlem Deaths at Disability Care Facilities

Autism centers in New York have a legal obligation to exercise reasonable care and protect patients from foreseeable sources of harm. This duty necessitates that they provide adequate supervision that is appropriate to the needs of all of their patients. Staff should also be well trained to deal with any type of physical encounter involving a patient. These facilities should take a number of other measures to prevent patients from being harmed.

  • Care Plans:Every patient of these facilities should have an individualized care plan that addresses their specific needs and behavioral triggers.
  • Crisis Training:These facilities should also be trained in crisis intervention and create space to avoid initiating physical contact.
  • Restraint Methods:The proper restraint methods should be used when any type of force does need to be applied.
  • Routine Audits:These facilities should be routinely audited to uncover any type of misconduct that could potentially put patients at risk.

When an autism care facility fails to take reasonable measures to protect patients from harm, this could form the basis of a negligence claim. Many of these claims will be centered around the idea that the staff involved in any incident were negligently hired or retained. Part of the problem is that there is a large amount of turnover at these types of institutions. This leads to situations where many of the employees are not particularly well trained.
