OSHA Investigating Brooklyn Accident at Demolition Site on Sheepshead Bay Road After Worker Fell From Scaffold
BROOKLYN, NEW YORK (October 23, 2026) – A worker was injured in Brooklyn after falling from a scaffold on the third floor of an interior demolition site located along Sheepshead Bay Road.
New York City officials are saying that the incident occurred sometime around October 5. A worker was reportedly on an elevated scaffold when they fell and suffered a back injury.
The city has cited the contractor for the accident. According to the citations, this contractor failed to safeguard persons who are affected by demolition work.
Paramedics were called to the scene of the accident to help the injured victim. That person was taken to a local trauma center to receive treatment.
A full investigation remains ongoing at this time.
Liability for Brooklyn Scaffold Accidents
General contractors and property owners can be held strictly liable for scaffold accidents in New York. New York’s Labor Law § 240(1) requires that employers take certain provisions to protect workers from falls and other gravity-related accidents. For the statute to apply, the worker must be engaged in a qualifying activity, including the demolition, repairing, altering, painting, or cleaning of a building. Courts will take into consideration several factors in evaluating liability for any scaffold accident.
- Fall Protection: They will consider whether the worker was provided with fall protection.
- Inspection Duties: They will review who is responsible for inspecting the scaffold.
- Safety Record: They will consider the safety record of the contractor involved in the accident.
- Structural Failures: They will try to identify any structural failures that may have been present with the scaffold.
When a general contractor fails to take reasonable measures to protect workers, this could serve as evidence of negligence. Consider, for example, Morales v. Spring Scaffolding, Inc., 24 A.D.3d 42 (2005). That case involved a contractor who fell and was injured after a bridge’s plywood perimeter barrier gave way. The court ultimately granted judgments under New York’s Labor Law § 240(1).
