Liability for Accidents Involving Falling Trees
Property owners have a legal obligation to maintain their premises in a reasonably safe condition. Moreover, property owners must warn of dangerous defects on a property that the defendant “should know or suspect that the licensee will not discover himself after a reasonable inspection of the premises” (Velez v City of New York, 45 AD2d 887). This obligation extends to protecting people from falling trees. Cities should take a number of actions to protect pedestrians from falling trees.
- Cities should routinely inspect and maintain all of the trees of their property.
- Cities should remove trees that show signs of disease or rot.
- Cities should avoid planting trees that have a high propensity to tip over in busy pedestrian areas.
When a property owner has actual or constructive notice of a dangerous tree on their premises, they must take action. Failing to take action could form the basis of a negligence claim. Any person injured by a falling tree is able to seek some measure of accountability through a civil claim. This right extends to the surviving family members of any person who is killed by a falling tree. They are able to seek some measure of accountability and justice through a wrongful death claim.
