BRONX, NEW YORK (August 27, 2026) – At least two people were critically injured in a Morris Heights, Bronx barbershop fire on West Burnside Avenue.

New York City officials are saying that the fire took place around 9:30 p.m. on Thursday night. Firefighters were called to the scene after getting reports of a fire.

A 29-year-old man and a 39-year-old woman were identified as victims. Both were transported to Jacobi Medical Center to receive treatment.

Authorities believe that the fire was sparked by lithium-ion batteries in an e-scooter. A full investigation into the incident remains ongoing.

Liability for New York City Barbershop Fires

Property owners in New York have a legal obligation to maintain a premises in a reasonably safe condition. This must be done for all persons on a property whose presence is reasonably foreseeable. Part of maintaining a safe commercial setting includes abiding by all fire and building codes. When a property owner has actual or constructive notice of a dangerous condition on their premises, they must take action. However, it is also possible that a defective device may start a fire. There are a number of potential issues with lithium-ion batteries that could potentially cause them to catch fire.

  • A battery may have contamination that causes internal short circuits.
  • A battery may have a defective thermal management system that causes overheating or excessive discharge.
  • A battery may have weak cell separators that allow positive and negative portions to come in contact with one another.
  • A battery may have physical damage that causes connectors or wires to touch each other.

If a property owner does not take reasonable measures to protect against foreseeable hazards, they could be held legally responsible for any resulting injuries. The company that manufactured the battery could also potentially bear some level of responsibility for a product liability claim. Most product liability claims are pursued under a theory of strict liability. In a strict liability claim, a product manufacturer will be liable for most incidents if their product was defective, even if they exercised a great deal of care to avoid harm.
