UPPER WEST SIDE, MANHATTAN (June 5, 2026) – Two people have tragically died and three people were critically injured in an Upper West Side pedestrian accident along Amsterdam Avenue.

New York City officials are saying that the accident took place around 6 PM on Friday. An elderly driver reportedly lost control of their vehicle before hitting several pedestrians.

Firefighters and paramedics were called to the scene of the crash to help all of the injured victims. Sadly, two people died due to their injuries.

Another three people were transported to local area hospitals to receive treatment. A full investigation into the circumstances of the crash remains ongoing.

Liability for Upper West Side Pedestrian Accidents

Drivers are required to use caution to avoid colliding with pedestrians in the roadway. According to New York Vehicle Code 1146, “every driver of a vehicle shall exercise due care to avoid colliding with any bicyclist, pedestrian, or domestic animal upon any roadway and shall give warning by sounding the horn when necessary.” There are many ways that a driver may have acted negligently prior to hitting a pedestrian.

  • A driver may have been distracted by looking at their cellphone.
  • A driver may have been traveling at a speed that would be unsafe given the prevailing road conditions.
  • A driver may have failed to check their blind spots before turning at an intersection.

If a driver fails to slow down to avoid colliding with a pedestrian, this could serve as evidence of negligence. There is a presumption of negligence on the part of any driver that goes onto a sidewalk before colliding with a pedestrian. These types of collisions nearly always involve drivers that are traveling too fast or otherwise not paying attention to the road ahead of them. Any person injured in a pedestrian accident may be able to pursue some measure of accountability through a civil claim.
