Lawsuit Filed Against Instant Noodle Cup Manufacturers

Epidemic of Children Being Burned by Instant Noodle Soups Leads to Several Lawsuits

Burn Injury Victims

NEW YORK, NEW YORK (December 21, 2025) – A number of lawsuits have been filed against the manufacturers of instant soups and noodle cups after many children have been seriously injured.

The lawsuits come after many thousands of children have been severely injured by the instant soups. In particular, it is estimated that roughly 25 children suffer severe burn injuries every day while consuming these soups.

That translates to nearly 10,000 children burned every year. Attorneys for the plaintiffs have argued that the design of the Styrofoam cups used to hold the instant noodles is defective.

Among other things, the tapered design makes them prone to tipping over and spilling their hot contents onto children.

Liability for Accidents Involving Instant Noodles

Companies that make consumer products have a legal obligation to ensure that they are reasonably safe. They must comply with all the federal safety guidelines and rigorously test the products in all of the ways that they will likely be used and even misused. If a consumer product has any type of defect that contributes to an accident, this could form the basis of a product liability claim. Product liability claims based on negligence may involve several types of alleged defects.

  • Design Defects: A product may have designed defects if it is likely to cause injuries during normal use. Design defects are inherent to the way a product is created.
  • Manufacturing Defects: A product may have manufacturing defects if only a limited number of items are problematic. Manufacturing defects occurred during the construction or creation of a product.
  • Marketing Defects: A product may have marketing defects if it lacks proper instructions or fails to warn consumers about non-obvious hazards.

Companies must take into consideration the foreseeability of injuries involving their products. If a company is aware that many people are being injured by their products every year, this could serve as evidence that they know that a problem exists. Unfortunately, companies will virtually never accept responsibility if children or adults are injured by their products. This is why it’s so important for victims to seek the guidance of an experienced product liability attorney.

Steps to Take After Injuries Involving Instant Noodles

Far too many children are seriously injured or burned every year in accidents involving instant noodles. According to Safety and Health Magazine, “Kids can get burned when hot noodles spill as they’re being removed from the microwave, and the narrow bases of noodle cups may contribute to spills while eating. Data showed that 40% of the burns happened when kids were left unattended.” Several steps should be taken after an injury involving instant noodles.

  • Medical Attention: Parents should seek medical attention for their children as soon as possible.
  • Evidence Preservation: All of the evidence associated with the injury should be collected and preserved.
  • Legal Support: Victims should seek the guidance of an experienced personal injury attorney as soon as possible.

There is a tremendous peace of mind that comes with having an experienced attorney handle your injury claim. They can take steps to identify all liable parties and ensure that your interests are always taken into consideration. There are no upfront fees to hire a personal injury attorney to handle your case. They work entirely on a contingency fee basis and only get paid by the opposing party if they are able to resolve your claim.
