Liability for Montclair Train Accidents
A number of people are injured in accidents with trains every year. According to the National Safety Council, “Railroad deaths totaled 954 in 2024, a 1% decrease from the 2023 revised total of 967. Nonfatal injuries totaled 6,542, a 3% decrease from the 2023 revised total of 6,768. From 2023 to 2024, fatalities at highway-rail crossings increased 7%, while fatalities involving other types of incidents decreased 4%.” Many different factors could cause a train accident.
- Train accidents are much more likely to occur if trains are traveling at an unsafe speed.
- Train accidents may be the result of improper communication between engineers and train stations.
- Train accidents may be the result of defects with a set of train tracks.
Train operators have a legal obligation to exercise a great deal of care to avoid collisions. They must maintain their vehicles at a safe speed at all times. They must also follow all state and federal regulations for operating trains. If a train fails to slow down to avoid colliding with a pedestrian, vehicles, or another train, this could form the basis of a negligence claim. It is important that certain steps are taken after any train accident.
- The victims should seek a thorough medical evaluation.
- Eyewitnesses should be interviewed.
- All of the evidence related to the crashes should be collected.
- An experienced personal injury attorney should be contacted.
It can be difficult to know where to begin after being injured in a train accident. Many victims are so seriously injured that they may need to take extensive periods of time away from work. They may also be burdened with high medical bills. Any person injured in the train accident may have legal recourse through a personal injury claim. Damages in a civil claim can help cover lost wages, medical bills, and pain and suffering.
