Liability for New York City Bicycle Collisions
Thousands of bicyclists are killed or seriously injured every year in bicycle accidents. According to the National Safety Council, “The number of preventable deaths from bicycle transportation incidents increased 10% in 2022 and have increased 47% in the last 10 years (from 925 in 2013 to 1,360 in 2022). At the same time, the number of preventable nonfatal injuries has declined 32%, from 493,884 in 2013 to 337,738 in 2022.” Drivers should take a number of actions in order to avoid hitting cyclists.
- Drivers should check their blind spots before making turns on the roadway.
- Drivers should slow down at night and during periods of reduced visibility.
- Drivers should use their horns when necessary to alert pedestrians of their presence.
Drivers must use caution in order to avoid hitting bicyclists and pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. When a driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a civil claim. There are a number of measures that cities could take in order to avoid pedestrian collisions.
- Cities can install traffic-calming measures in order to prevent speeding.
- Cities should study which roads and intersections are most impacted by car accidents.
- Cities should heavily enforce traffic violations likely to lead to collisions.
Depending on the facts of any case, a city could face civil liability for a pedestrian collision. In general, cities have a legal obligation to maintain their roadways in a reasonably safe condition. If a dangerous condition on public property contributed to a collision, this could form the basis of a civil claim. It is important that evidence is properly preserved after any collision.
