SHIRLEY, NEW YORK (January 29, 2024) – A 13-year-old boy was critically injured in a Shirley car accident with a police vehicle along William Floyd Parkway.

Shirley police officials are saying that the accident took place around 8:00 p.m. on Thursday. The 13-year-old boy was crossing the roadway when he was hit by a police vehicle.

Firefighters and paramedics were called to the scene of the collision in order to help the victim. The boy was taken to the hospital in order to receive care.

Liability For Shirley Police Vehicle Accidents

A police department could be liable if one of their officers is involved in a fatal pedestrian collision. According to New York Vehicle and Traffic Law 1104(e), the drivers of authorized emergency vehicles have a duty to operate their vehicle with due regard for the safety of all persons. When an officer shows a “reckless disregard” for the safety of others they could be liable for an accident during a police pursuit. There are a number of steps that should be taken after any fatal accident with a police vehicle.

  • Eye witnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • Dash cam footage from the police officer involved should be reviewed.

It is important that evidence is properly preserved after any police vehicle accident. Evidence will ultimately demonstrate who was at fault. Sadly, though, police departments will often do everything in their power to deny responsibility for injury collisions. A pedestrian accident attorney can examine the unique facts of your case and let you know what your legal options are.
