Liability For Manhattan Construction Accidents
Many construction accidents involve cranes. Cranes are an essential component of most construction projects. But they can also be very dangerous. According to the U.S. Bureau of Labor Statistics, “From 2011 to 2015, the Census of Fatal Occupational Injuries (CFOI) reported 220 total crane-related deaths, an average of 44 per year over this 5-year period. Men accounted for 217 of the 220 fatal injuries involving cranes.” There are a number of common causes of crane collapse accidents.
- Cranes may collapse due to improper assembly.
- Cranes may collapse due to mechanical failures.
- Cranes may collapse due to carrying excessive loads.
Depending on the facts of any case, a construction company could be liable for a construction accident through New York Labor Law § 200. This statute is a codification of an employer’s general duty to maintain job sites in a safe condition. According to the statute, “All machinery, equipment, and devices in such places shall be so placed, operated, guarded, and lighted as to provide reasonable and adequate protection to all such persons.” Victims of construction accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Construction sites tend to be very complex and often involve multiple companies working together. There could be numerous liable parties for any crane collapse including the manufacturer of the crane involved. Any person that is injured in a crane collapsed may have legal recourse through a civil claim. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
