Liability for Morris County Car Accidents
Thousands of pedestrians are killed or seriously injured every year in motor vehicle collisions. According to the GHSA, “Drivers struck and killed 7,148 people walking in the United States in 2024, down 4.3% from the year before and the second annual decline, but nearly 20% higher than the 2016 level.” Several factors could contribute to a pedestrian collision.
- Distracted driving
- Inclement weather
- Poor road conditions
- Driver fatigue
Drivers have a legal obligation to use care to avoid colliding with any pedestrian in the roadway. This includes situations where pedestrians may be outside of a marked crosswalk. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. The family of any pedestrian who died may have legal recourse through a wrongful death claim.
