Liability for Martinsburg DUI Accidents
Driver intoxication remains one of the leading causes of car accidents in the United States. According to the NHTSA, “Every day, about 34 people in the United States die in drunk-driving crashes — that’s one person every 42 minutes. In 2023, 12,429 people died in alcohol-impaired driving traffic deaths.” Even small amounts of alcohol can drastically impair a person’s ability to operate a vehicle safely.
- Intoxicated drivers have reduced coordination.
- Intoxicated drivers have reduced small muscle control.
- Intoxicated drivers have reduced ability to maintain a lane position.
It is illegal to operate a motor vehicle under the influence of alcohol or drugs. If a driver enters into opposing lanes of traffic and strikes another vehicle while intoxicated, this could form the basis of a negligence claim. The family of any person who died in such a collision may be able to pursue some measure of accountability through a civil claim.
