One Person Killed in Fatal Martinsburg DUI Car Accident

Ford F-350 Crossed Center Line on State Route 13 Prior to Fatal Collision in Martinsburg

Winslow Township Car Accident

MARTINSBURG, NEW YORK (February 5, 2026) – One person has tragically died in a head-on car accident in Martinsburg on State Route 12.

Lewis County officials are saying that the accident took place around 6:42 p.m. on Saturday. The driver of a Ford F350 truck was heading southbound on State Route 12.

He allegedly crossed into opposing lines of traffic before colliding head-on with another vehicle. Paramedics were called to the scene of the accident to help the victims.

Sadly, one person died due to the severe nature of their injuries. The driver of the truck has since been charged with aggravated homicide. He also is alleged to have a blood alcohol content above the legal limit at 0.19%.

Liability for Martinsburg DUI Accidents

Driver intoxication remains one of the leading causes of car accidents in the United States. According to the NHTSA, “Every day, about 34 people in the United States die in drunk-driving crashes — that’s one person every 42 minutes. In 2023, 12,429 people died in alcohol-impaired driving traffic deaths.” Even small amounts of alcohol can drastically impair a person’s ability to operate a vehicle safely.

  • Intoxicated drivers have reduced coordination.
  • Intoxicated drivers have reduced small muscle control.
  • Intoxicated drivers have reduced ability to maintain a lane position.

It is illegal to operate a motor vehicle under the influence of alcohol or drugs. If a driver enters into opposing lanes of traffic and strikes another vehicle while intoxicated, this could form the basis of a negligence claim. The family of any person who died in such a collision may be able to pursue some measure of accountability through a civil claim.
