Survivors of Sexual Abuse in New York City May Soon Be Able to Pursue Civil Actions After Previous Denials Due to Statute of Limitations
MANHATTAN, NEW YORK (January 9, 2025) – Victims of sexual abuse in New York City may soon be able to pursue civil claims due to a major development that is happening at City Hall.
Prior to the end of his term, outgoing Mayor Eric Adams issued a veto for a passed bill that would have reopened the lookback window for sexual abuse claims. However, City Council leaders are now working to override that veto.
Many victims of sexual abuse were previously unable to pursue civil claims due to expired statutes of limitations. But the proposed lookback window would change this.

Why the Lookback Window Matters for Survivors
In short, a lookback window is a temporary legal provision that would lift statute of limitation requirements related to pursuing civil claims related to sexual abuse. They are important because many victims of sexual abuse do not come forward until long after the statute of limitations expires. It is very common for victims to avoid coming forward due to trauma and stigma associated with sexual victimization. Many different survivors could benefit under the proposed law.
- Survivors of sexual abuse and violence could pursue claims against those individuals that caused their harm.
- Survivors would be able to pursue civil claims against the institutions that failed to adequately protect them from their perpetrator.
- Survivors would be able to pursue claims, even in instances where the abuse occurred many decades ago.
- The lookback window would be open for 18 months after the law finally goes into effect.
This would not be the first time that lookback window has gone into effect in New York. There was a lookback window following the passage of the Child Victims Act (CVA). A number of lawsuits were filed against various institutions as a result of that law. This includes youth centers, hospitals, and schools. Juvenile detention centers also had many claims brought against them. The Adult Survivors Act also created a one-year lookback window, but that window closed in November 2023.
Steps to Take After Sexual Abuse in New York City
Sexual abuse remains a major issue across New York City. Many children and even adults have been victimized over the years. This has led to various legal claims against the city. According to City & State New York, “New York City paid over $160 million to settle more than 150 legal actions since the Child Victims Act was passed five years ago, most of which were filed against the Department of Education, and while former investigators at a watchdog agency claimed they were told to reverse substantiated accusations of sexual abuse made by victims, according [to] a City & State investigation.” Victims of sexual abuse in NYC should take a number of actions to protect their legal rights.
- Don’t Assume: Even if you have sought legal representation in the past, don’t assume that you are still unable to pursue a claim. There is a good chance you will have the opportunity to pursue justice if the lookback window is reopened.
- Preserve Evidence: Be sure to preserve as much evidence as possible. This will include emails, text messages, diary entries, medical records, and photos.
- Seek Legal Counsel: Any person harmed by sexual abuse in New York City should seek the guidance of an experienced New York sexual abuse lawyer. An attorney can evaluate the unique facts of your case and let you know what your legal options are.
Sexual abuse routinely leaves survivors with lasting physical and emotional trauma. Survivors have reported that they often contend with anxiety, depression, and post-traumatic stress disorder. It is therefore not surprising that so many victims choose not to come forward. For many people, the inability to hold their abusers accountable after months or years of abuse adds insult to injury. But it doesn’t have to be this way. The NYC Council and mayor’s office can do the right thing and reopen the lookback window.
