EMS and firefighters were pulled to the scene of the crash to help all of the victims. At least five firefighters were injured and 14 people on the MTA bus were hospitalized.
The circumstances surrounding the incident remained unclear at this time. The full investigation remains ongoing.
Liability for Bronx MTA Bus Accident
New York law gives emergency vehicles certain privileges when they are responding to an emergency with their lights and sirens on. For example, New York Vehicle and Traffic Law § 1104 allows emergency drivers to speed and disregard other traffic rules in certain situations. But these privileges do not eliminate their responsibility to drive in a reasonably safe manner. In particular, a fire department could potentially be liable for an accident if the driver of a firetruck operated with a reckless disregard for the safety of the public. Investigators were taking into consideration many different factors when determining liability for any collision.
- Investigators will consider the speed of all vehicles involved.
- Investigators will look at whether or not an emergency vehicle was using their lights and sirens at the time of the collision.
- Investigators will consider any footage captured by onboard cameras.
- Investigators were taking into consideration traffic and visibility conditions at the time of the collision.
MTA bus operators are considered common carriers and held to a very high standard in terms of safety. They must operate within an abundance of caution to avoid accidents with other vehicles. When a bus driver fails to use reasonable care to avoid colliding with a truck or other vehicle, this could serve as evidence of negligence. Any person injured in such a collision may be able to pursue some measure of accountability through a personal injury claim. Damages in such a claim can help cover lost wages, medical bills, and pain and suffering.
