Liability In New Haven Construction Accidents
The construction industry remains quite hazardous for workers despite better safety standards over the years. According to The Checker, “The Fatal 4 amount to 60% of all deaths in construction 38.7% of all deaths in construction happened from falling 9.4% of all deaths in construction occurred when an object struck the person.” There are a number of steps that should be taken in order to protect workers from falling objects.
- Workers should be properly trained in order to identify hazards.
- Nets should be installed in certain areas.
- Work sites should be well maintained.
Construction companies have a legal responsibility to maintain their work sites in a reasonably safe condition under New York Labor Law 200. When a construction site is in a dangerous condition, the construction company responsible for the site could face civil liability. A large number of workplace accidents occur when companies fail to follow OSHA guidelines. There are a number of steps that should be taken after any construction accident.
- Medical records should be preserved.
- Eye witnesses should be interviewed.
- Surveillance footage should be sought.
- A thorough, independent investigation should be conducted.
The family of any worker that is killed in an accident may have legal recourse through a wrongful death claim. Potential beneficiaries in a civil claim will typically include a victim’s spouse and children. Sadly, construction companies will often fight extremely hard to deny liability for any accident. This is why it is so important that evidence is properly preserved after any collision.
