Liability For New York City Bicycle Accidents
Thousands of people are seriously injured or killed every year in bicycle collisions. According to the National Highway Traffic Safety Administration, “For the last 5 years (2017 to 2021), the yearly average has been 883 people on bicycles killed in police reported traffic crashes (NCSA, 2022; Stewart, 2023). Bicyclists accounted for 2.2% of total traffic fatalities in 2021 (Stewart, 2023).” Drivers should take a number of measures in order to avoid collisions.
- Every driver should check their blind spots before making turns.
- Every driver should use their turn signals to alert other drivers and pedestrians of their presence.
- Every driver should abstain from alcohol and other intoxicating substances.
All drivers must use care in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver makes a dangerous left turn in front of a bicyclist, this could form the basis of a negligence claim. It is crucial that evidence is properly preserved after a collision.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- Photos of the accident site should be taken.
Pedestrian accidents are often highly preventable. They tend to involve situations where drivers are not paying adequate attention to the road ahead of them. It is important that accident victims are aware of their rights and that those rights are being protected.
