Liability for Floral Park School Bus Accidents
School bus drivers are considered common carriers. They must operate with an abundance of caution to avoid collisions. According to Squaw Valley Ski Corp. v. Superior Court, “This elevated standard of care for common carriers has its origin in English common law. It is based on a recognition that the privilege of serving the public as a common carrier necessarily entails great responsibility, requiring common carriers to exercise a high duty of care towards their customers.” It is important that certain actions are taken after a school bus accident.
- Eyewitnesses should be interviewed.
- Medical reference related to decoration should be sought.
- Surveillance footage should be reviewed.
- Photos of the accident site should be taken.
- Victims should seek the guidance of an experienced attorney.
Bus drivers must slow down to avoid colliding with any pedestrian in the roadway. If a bus driver fails to slow down to avoid hitting a pedestrian, they could be held at fault through a civil claim. Moreover, the school district or private company that they worked for could also be held at fault. Generally speaking, employers can be held vicariously liable for the wrongful actions of their workers. The family of any person who died may be able to seek some measure of accountability through a wrongful death claim.
