Liability For New York DUI Accidents

Thousands of people are killed every year in accidents with intoxicated drivers. According to the Centers for Disease Control, “In 2020, 11,654 people were killed in motor vehicle crashes involving alcohol-impaired drivers, accounting for 30% of all traffic-related deaths in the United States. This was a 14.3% increase compared to the number of crash deaths involving alcohol-impaired drivers in 2019.” Even small amounts of alcohol can substantially impair a driver.

  • Drivers are less able to stay in their lane.
  • Drivers are less able to keep their eyes on the road.
  • Drivers are less able to react to obstacles ahead of them.

It is illegal to operate any motor vehicle under the influence of alcohol or drugs. Any person that causes a collision under the influence may be subject to criminal and civil liability. The family of any person that died in a DUI accident may have legal recourse through a civil claim. It is important that evidence is properly preserved after any car accident.
