Liability For Lower East Side Motorcycle Accidents
Motorcyclists are uniquely vulnerable to the hazards posed by collisions. According to the IIHS, “A total of 5,579 motorcyclists died in crashes in 2020. That is the highest number recorded and an 11 percent increase from 2019. Motorcycle deaths accounted for 14 percent of all motor vehicle crash deaths in 2020 and were more than double the number of motorcyclist deaths in 1997.” There are many different factors that could contribute to a motorcycle accident.
- Speeding
- Distracted driving
- Inclement weather
- Poor road conditions
All drivers have a legal obligation to exercise due care in order to avoid causing accidents. To that end, all drivers must operate their vehicles at a safe speed. If a driver fails to reduce their speed in order to avoid a collision, this could form the basis of a negligence claim. It is important that certain steps be taken after any collision.
- Surveillance footage should be sought.
- The police report should be collected.
- A thorough investigation should be conducted.
- A motorcycle accident attorney should be contacted.
The vast majority of motorcycle accidents are preventable. They could involve many different factors, including vehicle system failures. For example, if a tire on a motorcycle malfunctioned, this could easily lead to a crash. The family of any person who died in a collision may be able to seek some measure of justice through a civil claim.
