Liability For Brooklyn MTA Bus Accidents

The MTA bus system is responsible for thousands of injury collisions every year. According to one report from the New York Post, “At least 2,520 people — or 2.7 per day — were injured [from 2015 – 2018], according to the MTA. At least 14 people died, including a 25-year-old skateboarder, a 62-year-old pedestrian, a 60-year-old motorist and a 70-year-old with a walker who was mutilated by a hit-and-run bus.” Several different factors could contribute to a bus accident.

  • Bus collisions are more likely during periods of inclement weather.
  • Bus collisions are more likely in urban areas.
  • Bus collisions are more likely at night when visibility is reduced.

Bus companies are considered common carriers, and their drivers are expected to exercise the utmost caution in order to avoid collisions. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a bus driver fails to slow down in order to avoid hitting a pedestrian, this could form the basis of a negligence claim. Victims of bus accidents often suffer many negative consequences as a result of the crash.

  • Victims may suffer reduced mobility due to their injuries.
  • Victims may need to take time off of work.
  • Victims may be left with high medical bills.

Depending on the facts of any case, the company or municipal entity that operates a bus could be liable for a collision. Generally speaking, employers are liable for the wrongful actions of their employees. Any person who is injured in a bus accident may be able to seek some measure of justice through a civil claim. A bus accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
