New Jersey School District Pays $4.2 Million to Bullied Student
Most would agree that school districts have some moral obligation to prevent bullying, but there is an open question of whether a district is legally responsible for failing to act when they knew about a threat.
A New York school district recently settled a lawsuit for $4.2 million after a middle school student was paralyzed by a bully’s punch.
In 2006, Sawyer Rosenstein, then 12, was punched in the stomach. Two days later, he found himself unable to walk due to a blood clot. Rosenstein has been paralyzed from the waist down ever since.
In a lawsuit, Rosenstein’s New York personal injury lawyer alleged that the school knew about the bully’s violent tendencies and failed to prevent the attack.
The bully had previously punched another student in the face, but the school kept no record of that attack. Rosenstein’s lawsuit also alleged that the school did not comply with a state anti-bullying law.
Three months before the attack, Rosenstein had e-mailed school officials to report the bullying, saying “I would just like to put this on file so if something happens again, we can show that there was past bullying situations.”
The school district still denies any wrongdoing and says that it was the school’s insurance carriers who decided to settle with the Rosensteins and their New York personal injury lawyer. The district said that their “character education and harassment/intimidation/bullying initiatives and reporting practices” exceeded state criteria.
Rosenstein’s family had previously settled a claim against the attacker for an undisclosed amount.
Rosenstein is now a communication major at Syracuse University and hosts a podcast about outer space.

The AP recently published an article (Study Finds MDs Not Always Honest with Patients; Lauren Neegaard- February 8, 2012) and revealed some frightening statistics.
The article summarized the findings of a 2009 Massachusets researchers survey of over 1,800 doctors nationwide.
Twenty percent of those surveyed admitted to not fully disclosing a mistake that they had made, and 30% didn’t feel that a doctor should always admit to a mistake. The findings did not specify why doctors felt that way or what mistakes they had not disclosed. Ten percent of doctors even admitted to actually lying to a patient within the last year.

The Food and Drug Administration issued a warning in June 2011 that diabetic patients who have taken Actos and other pioglitazone-containing medicines are at a higher risk of developing bladder cancer. The warning notes that the risk is higher in patients who have taken higher dosages of Actos for more than 12 months.
France has stopped the release of these drugs. The FDA noted that it was aware of France’s decision. However, the FDA has not banned these medicines from being issued in the United States.

(Bronx, NY) August 15, 2011 – The Bronx was host to some of the best street ball on the East coast this past weekend for the 6th Annual Gardiner Memorial Basketball Classic Tournament, held in St. James Park and run by The Gardiner Foundation August 13 and 14, 2011. The tournament, sponsored by Gersowitz Libo & Korek, P.C. (Lawyertime.com), offered free food and beverages and non-stop entertainment to all spectators.
Saturday was filled with four electrifying games that saw monster jams, amazing ball-handling and hard-fought competition. State Senator Gustavo Rivera stopped by to show his support for the Gardiner Foundation and the Bronx community.

Sunday’s rain caused the Tournament to be moved indoors to the famous Gaucho’s Gym on Gerard Ave, but that didn’t stop the crowds from coming out to catch the live entertainment, semi-final action and the youth 12 and under all-star game. Most importantly, the Bronx came together to honor their neighbors who have lost loved ones throughout the year and to support and encourage the youth of the community. The Gardiner Foundation handed out five $1,500 scholarships to college-bound high school seniors, 100 backpacks filled with school supplies to youth in attendance and raffled off 13 laptops.

The Gardiner Foundation was established in 2006 by Dexter Gardiner, in memoriam of six of his family members who lost their lives in a horrific car accident on the Bronx River Parkway. Building upon his family’s legacy of helping others in need and involvement in the game of basketball, the Foundation embarked on a community outreach initiative that offers educational scholarships and financial support, emotional and spiritual guidance and burial assistance to other families in the community who have suffered a sudden and tragic loss. “Since its inception, The Foundation has awarded sixteen scholarships to students entering college for the first time and continues to be an expression of hope, resilience and commitment to the Bronx community,” said Alan Farrell, an organizer for The Gardiner Foundation’s two-day event.
Gardiner met Jeff Korek, a partner at the personal injury law firm Gersowitz Libo & Korek, P.C. (Lawyertime.com), a few years ago when they played in the same amateur basketball league. As Korek and Gardiner continued to play basketball together, Korek learned about The Gardiner Foundation and the amazing work it was doing for the community.
