Liability for North Hills Truck Accidents
Speeding remains one of the major causes of preventable car accidents across New York and the United States. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2024, speeding was a contributing factor in 29% of all traffic fatalities.” Truck companies should take several actions to prevent collisions.
- Truck companies should ensure their vehicles are periodically inspected.
- Truck companies should ensure that their drivers have the appropriate commercial license.
- Truck companies should consider equipping their vehicles with safety features such as forward collision avoidance systems.
If a truck driver fails to slow down to avoid hitting a vehicle, this could serve as evidence of negligence. There is a presumption of negligence on the part of any driver that collides with the rear of another vehicle in their own lane of traffic. If a truck driver rear-ends a vehicle, their employer could also be held at fault. A carrier could also be liable if they hired a truck company with a poor safety record.
