Liability for New York Bicycle Accidents
Many people are killed or seriously injured every year in bicycle accidents. According to the National Safety Council, “Bicycle-related deaths peak in the warmer months, starting in June, and they remain high through October. In 2024, the highest number of deaths occurred in August (116 deaths) and the fewest in January (74 deaths).” Drivers should take a number of actions to prevent bicycle accidents.
- Drivers should check their blind spots before making turns in the roadway.
- Drivers should abstain from alcohol and other intoxicating substances.
- Drivers should always maintain a safe distance from the vehicles ahead of them.
If a driver fails to slow down to avoid hitting any cyclist in the roadway, this could serve as evidence of negligence. Even if a pedestrian is outside of a marked crosswalk, this does not relieve a driver of their duty to exercise due care. Any person injured in a car accident may have legal recourse through a personal injury claim. A personal injury claim can help cover lost wages, medical bills, and pain and suffering.
