Liability For Brooklyn Construction Accidents

Falls are the most common causes of serious injury and death for workers across New York. In fact, the Occupational Safety and Health Administration (OSHA), has listed falls as one of the “fatal four” causes of workplace injury. Around 35.6% of all workplace deaths are due to falls. For the most part, falls are totally preventable. There are many steps that companies can take to prevent their workers from being injured in falls.

  • Workers should be given personal fall arrest systems when they are working at heights at 6 feet or higher.
  • Workers should be properly trained before every construction job.
  • Guardrails should be installed in certain locations.

A building owner or general contractor could be liable for any accident where a worker is injured after falling. Commonly referred to as the “Scaffold Law” New York State Labor Law § 240 imposes strict liability on construction companies, contractors and building owners when a worker falls or is hit by a falling object. Victims of falls tend to suffer very serious injuries including:

  • Broken bones
  • Head injuries
  • Lacerations
  • Spinal cord injuries

The vast majority of construction accidents are preventable. They tend to involve construction companies that are cutting corners in terms of safety. Any person that is injured in a construction accident may be able to seek some measure of justice through a civil claim. A construction accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
