COLLEGE POINT, NEW YORK (November 3, 2026) – A construction worker was injured in a construction accident at a building site on 40th Road in College Point.

Queens County officials are saying that the accident took place on Saturday. The New York City Department of Buildings reported that the worker was at a job site at 131-28 40th Road when he fell.

First responders were called to the scene of the accident to help the victim. He was transported to a local area hospital to receive treatment. As of Sunday, the department did not post any violations or work orders at the site in question.

A full investigation remains ongoing at this time.

Liability for College Point Construction Accidents

New York gives construction workers some of the strongest fall protections in the country. Under Labor Law § 240(1), often called the Scaffold Law, owners and contractors must furnish scaffolding, ladders, hoists, and other devices built and placed to give workers proper protection from elevation-related hazards. Owners and contractors can be legally responsible for accidents at these work sites, even if they did not directly supervise the location where it took place. Investigators will typically focus on several key areas when examining legal responsibility.

  • Safety Equipment: They will determine whether owners and contractors supplied scaffolding, guardrails, and other necessary safety equipment.
  • Anchor Points: They will examine whether or not there were sufficient anchoring points that workers could hook themselves to to prevent falls.
  • Ladder Condition: The condition of ladders and other safety equipment at the site should be considered.
  • Competent Person: It also matters whether there was a competent person to oversee safety operations and inspect conditions.

The Court of Appeals clarified how this protection works in Blake v. Neighborhood Housing Services of New York City, decided in 2003. That case involved a plaintiff who fell from an extension ladder during work at a two-family house in the Bronx. The court explained that liability under the Scaffold Law depends on whether or not there is a statutory violation that is a proximate cause of the injury. This can include situations where workers should’ve been provided with a personal fall arrest system, and were not.
