OSHA Investigating Fatal Bushwick, Brooklyn Trench Collapse Accident at Construction Site on Jefferson Street

Construction accidents

BUSHWICK, BROOKLYN (April 21, 2026) – A construction worker has tragically died, and another worker was injured in a Bushwick trench collapse accident.

New York City officials are saying that the accident took place around 8:30 AM on Thursday morning. Two workers were operating inside of the trench when it suddenly collapsed.

Firefighters and paramedics were called to the scene of the accident to help both of the victims. A 40-year-old worker was transported to a local area hospital with major injuries.

Another worker was pronounced dead at the scene. The Department of Buildings has since issued a full stop-work order.

Liability for Bushwick Trench Collapse Accidents

Construction companies have a legal obligation to maintain all their premises in a reasonably safe condition. They can be held directly liable for accidents proximately caused by a dangerous condition on their premises. Pursuant to New York Labor Law § 200, worksites must be “constructed, equipped, arranged, operated and conducted as to provide reasonable and adequate protection to the lives, health and safety of all persons employed therein or lawfully frequenting such places.” There are several errors that a construction company may have made that contributed to a trench collapse.

  • Engineering firms may have missclassified the soil surrounding a trench before work began.
  • A construction company may have placed heavy equipment on the sides of the trench that put undo stress on it.
  • A construction company may have failed to ensure that a trench had proper water drainage.
  • The walls of a trench may not have been properly shored and braced as it was being constructed.

When a construction company fails to follow OSHA guidelines related to the construction of a trench, this could serve as evidence of negligence. Trench collapses are nearly always preventable. They tend to involve situations where safety regulations are being ignored. Any person injured in a trench collapse may have legal recourse through a personal injury claim. This right also extends to the family members of any person who died in a trench collapse.
