Liability for New York City Pedestrian Accidents

Thousands of people are killed in hit-and-run collisions every year in the United States.  According to the NHTSA, “There were 2,932 fatalities in traffic crashes involving hit-and-run drivers in 2022, an increase of 0.5 percent from 2,917 in 2021. Of the 7,522 pedestrian fatalities, 1,910 (25%) were involved in hit-and-run crashes in 2022.  Of the 1,105 pedalcyclist fatalities, 265 (24%) were involved in hit-and-run crashes in 2022.” Several factors could contribute to any hit-and-run collision.

  • Hit-and-run collisions often involve a driver who is speeding.
  • Hit-and-run collisions are much more likely at intersections.
  • Hit-and-run collisions usually involve a driver who is intoxicated.

All drivers have a legal obligation to avoid hitting pedestrians in the roadway. They must be particularly cautious around children and any person who appears to be confused. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of the negligence claim. Victims of pedestrian accidents tend to suffer very serious injuries.

  • Broken bones
  • Have injuries
  • Lacerations
  • Spinal cord injuries
  • Death

The vast majority of pedestrian accidents are completely preventable. In fact, it’s estimated that 93% of all accidents involve some amount of human error. Sadly, drivers often do everything in their power to not take responsibility if they hit a pedestrian. This side is so crucial that all pedestrian accidents are thoroughly investigated by an outside party.
