Liability for Long Island Car Accidents
Drivers must use caution to avoid colliding with other vehicles in the roadway. According to NY Veh & Traf L § 1141, “The driver of a vehicle intending to turn to the left within an intersection or into an alley, private road, or driveway shall yield the right of way to any vehicle approaching from the opposite direction which is within the intersection or so close as to constitute an immediate hazard.” Many factors could contribute to car accidents.
- Drivers may not pay sufficient attention to cross traffic as they are making left turns.
- Drivers may be intoxicated by alcohol or other substances.
- Drivers may be distracted by their phone or even conversations with passengers.
It is illegal for any person to operate a motor vehicle under the influence of alcohol or drugs. Drivers that cause accidents while intoxicated may face criminal as well as civil liability for their actions. If a truck was being used for commercial purposes at the time of the crash, the company that owned or operated the truck could also face legal accountability through a civil action. It is important that certain measures are taken after a fatal collision.
- The police should be called to the scene as early as possible.
- Surveillance footage of the crash should be sought.
- Eyewitnesses should be interviewed.
- Surviving family members should carefully consider their legal options.
The vast majority of car accidents are totally preventable. They tend to involve situations where drivers are not following traffic regulations. The family of any person who died in a DWI accident may be able to seek some measure of accountability and justice through a wrongful death claim.
