Liability For Long Island Pedestrian Accidents
Pedestrians lack the protection of enclosed vehicles and are more likely to be overlooked. According to the Governors Highway Safety Association, “GHSA previously issued a report finding that 3,434 pedestrians were killed on U.S. roadways in the first half of 2022, based on preliminary data reported by State Highway Safety Offices. A second report analyzing state-reported data for all of 2022 found that roadways continue to be incredibly deadly for pedestrians.” There are a number of steps that drivers should take to avoid hitting pedestrians.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should use their horn when necessary to alert pedestrians of their presence.
- Drivers should continuously scan the road ahead of them for hazards.
Every driver has a legal obligation to take reasonable measures in order to avoid hitting pedestrians. Drivers must slow down in order to avoid collisions. They must also use their horns when necessary. It doesn’t matter if a pedestrian is outside of a marked crosswalk. Drivers must remain vigilant. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any pedestrian collision.
- A police report should be created.
- Eyewitnesses should be interviewed.
- Surveillance footage should be sought.
Pedestrian accidents are often highly preventable. Drivers may be distracted by their phones or other devices. A large number of pedestrian collisions involve drivers traveling too fast for the prevailing conditions. Victims of pedestrian accidents are protected by a number of laws. In particular, the family of any person who died in a pedestrian accident may be able to seek some measure of justice through a civil claim.
