Liability In Nassau County Pedestrian Accidents

Far too many pedestrians are killed or seriously injured every year in New York. According to the New York Department of Health, “On average there were 312 deaths each year due to motor vehicle traffic-related pedestrian injuries, killing 1.6 of every 100,000 New Yorkers. The rates were highest for males and New Yorkers 65 and older.” There are a number of factors that could contribute to a pedestrian collision including:

  • Speeding
  • Distracted driving
  • Inclement weather
  • Drowsy driving
  • Dangerous turns

All drivers have a legal obligation to exercise due care in order to avoid hitting pedestrians, bicyclists and domestic animals. The vast majority of pedestrian collisions can be prevented when drivers simply slow down. If the driver of a van was working at the time of a collision, the company that they were working for could be vicariously liable. Many vans are used for commercial purposes such as medical transport. There are a number of steps that should be taken after any pedestrian collision.

  • Surveillance footage should be sought.
  • All eye witnesses should be interviewed.
  • Medical records should be examined.
  • The employment status of the at-fault driver should be determined.
  • A pedestrian accident attorney should be conducted.

Any person that is injured in a car accident may have legal recourse through a bodily injury claim. Damages can help with lost wages, medical bills and pain and suffering. Even after a victim recovers physically, they could still suffer from long term psychological injuries. A New York pedestrian accident attorney can examine all of the facts of your case and let you know what your legal options are.
