Liability For New York School Bus Accidents
School buses are considered “common carriers” under the law, and their drivers are held to a high standard in terms of safety. They must do everything that human care and vigilance can do to avoid collisions. School buses can weigh ten to twenty times more than a passenger vehicle. There are a number of factors that could contribute to a school bus collision.
- Speeding
- Distracted driving
- Dangerous left turns
- Inclement weather
- Poor road conditions
All drivers have a legal obligation to exercise due care in order to avoid causing accidents. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. Any person injured in a school bus accident may have legal recourse through a civil claim.
