Liability For New York City Motorcycle Accidents

Speeding remains one of the leading causes of car accidents in the United States. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2022, speeding was a contributing factor in 29% of all traffic fatalities.” Several other factors could contribute to any car accident.

  • Distracted driving
  • Inclement weather
  • Poor road conditions
  • Driver intoxication

All drivers have a legal obligation to take steps in order to avoid collisions. This means that they must drive at a safe speed at all times. Depending on the prevailing conditions of the roadway, a driver may need to travel well under the speed limit. When a driver fails to slow down in order to avoid a collision, this could form the basis of a civil claim. It is important that certain steps are taken after any car accident.

  • Surveillance footage should be sought.
  • Medical records should be preserved.
  • Eyewitnesses should be interviewed.
  • The police report for the collision should be collected.

The vast majority of car accidents are preventable. They tend to involve at least some amount of human error. This is particularly true when drivers of larger vehicles make turns. It is common for drivers to fail to check their blind spots. It is important for accident victims to understand that they do have rights. The family of any person who died in a motorcycle collision may be able to seek some measure of justice through a wrongful death claim.
