Liability In Wallkill Car Accidents
Speed is one of the most common contributing factors for car accidents in the United States. According to the National Highway Traffic Safety Administration, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2019, speeding was a contributing factor in 26% of all traffic fatalities.” There are many situations where a driver may need to operate their vehicle below the speed limit.
- Heavy rain
- Heavy fog
- Sharp curves in the roadway
- At night
All drivers have an obligation to exercise due care in order to avoid collisions. Pursuant to New York Vehicle Code § 1180, no person shall drive a motor vehicle at a speed than would be safe and reasonable given the prevailing conditions of the roadway. Drivers are more likely to lose control of their vehicle at higher speeds. Victims of car accidents often suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
Any person that is injured due to the negligent actions of another driver may have legal recourse through a bodily injury claim. A bodily injury claim can help victim’s recover damages such as medical bills and pain and suffering.
