Liability For New York City Pedestrian Accidents

Far too many people are killed or seriously injured in pedestrian collisions in New York every year. According to the New York State Department of Health, “Injuries to pedestrians are among the top 10 leading causes of injury-related hospital admissions and death for almost all age groups In New York State. Approximately 300 pedestrians are killed and 15,000 are injured by motor vehicles each year on the state’s roadways, and more than 3,000 pedestrians are admitted to the hospital annually.” Cities can take several measures in order to prevent pedestrian collisions.

  • Cities can install traffic calming measures in areas where drivers routinely speed.
  • Cities can install pedestrian bridges in locations with heavy traffic.
  • Cities can choose to heavily enforce traffic infractions likely to lead to pedestrian collisions.

All drivers must take measures in order to avoid hitting pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. It is important that certain steps are taken after any pedestrian collision.

  • Eyewitnesses should be interviewed.
  • Medical records should be preserved.
  • Surveillance footage should be sought.
  • An experienced pedestrian accident attorney should be contacted.

Pedestrians lack the protection of enclosed vehicles and are more likely to be overlooked. It is very common for drivers to simply not pay attention to the road ahead of them and hit pedestrians as they are crossing the street. Any person injured in a pedestrian collision may have legal recourse through a civil claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
