Liability for Queens Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured every year in collisions with vehicles. According to the NHTSA, “the number of pedestrian fatalities has increased since 2009, leading to a 5-year average of 6,502 pedestrian deaths during the 5 most recent years (2017 to 2021). During this period, pedestrians accounted for 16 or 17% of total traffic fatalities (NCSA, 2023c).” Drivers should take a number of actions to avoid colliding with pedestrians.
- Drivers should slow down in areas with heavy pedestrian traffic.
- Drivers should abstain from alcohol and other intoxicating substances.
- Drivers should maintain their vehicles at a safe speed.
Drivers in New York must abide by all vehicle codes and use the caution necessary to avoid hitting any pedestrian. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care in order to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid colliding with any pedestrian, this could form the basis of a negligence claim. Certain actions should be taken after any pedestrian crash.
- The police should be called to the scene as soon as possible so that they can start investigating.
- Surveillance footage of the accident should be sought.
- Victims of pedestrian accidents should seek the guidance of an experienced attorney.
Going through a pedestrian accident is often one of the most difficult things that most people will go through in their lives. Victims often are left with serious injuries and may need to take extensive periods of time away from work. Losing a loved one can be absolutely devastating. Surviving family members are able to seek some measure of accountability through a wrongful death claim.
