Liability For New York Pedestrian Accidents
Speed remains one of the leading causes of car accidents. According to the NHTSA, “For more than two decades, speeding has been involved in approximately one-third of all motor vehicle fatalities. In 2020, speeding was a contributing factor in 29% of all traffic fatalities.” There are many steps that drivers should take in order to avoid hitting pedestrians.
- Drivers should check their blind spots before turning.
- Drivers should slow down during periods of inclement weather.
- Drivers should abstain from alcohol and other intoxicating substances.
Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. If a driver fails to slow down to avoid hitting a bicyclist, this could form the basis of a negligence claim. Victims of pedestrian accidents tend to suffer very serious and costly injuries, including:
- Broken bones
- Head injuries
- Lacerations
- Spinal cord injuries
If a livery driver was working at the time of a collision, their employer could be held at fault. In general, employers are liable for the wrongful actions of their employees, insofar as those employees were working within the course and scope of their job duties. Any person who is injured in a car accident may have legal recourse through a civil claim. A pedestrian accident attorney can examine all of the unique facts of your case and let you know what your legal options are.
