Liability For New York Pedestrian Accidents
Thousands of pedestrians are killed or seriously injured in collisions every year. According to the Centers for Disease Control, “Nearly 8,000 pedestrians were killed on our nation’s roads in crashes involving a motor vehicle in 2021. That’s about one death every 66 minutes. One in six people who died in crashes in 2021 were pedestrians.” There are a number of factors that could contribute to pedestrian collisions.
- Pedestrian collisions are much more likely to take place when drivers are fatigued. Staying awake for only 18 hours can reduce a person’s ability to drive safely, which is equal to driving with a BAC of 0.05%.
- Pedestrian collisions are much more likely when drivers are intoxicated. Even a small amount of alcohol can seriously impair a person’s ability to operate their vehicle safely.
- The vast majority of collisions involve one or more drivers who are speeding. Drivers are more likely to lose control of their vehicles at higher speeds.
All drivers must use caution in order to avoid colliding with pedestrians. Pursuant to New York Vehicle Code 1146, all drivers must exercise due care to avoid hitting pedestrians, bicyclists, and domestic animals in the roadway. Many pedestrian collisions involve drivers who are not adequately scanning the road ahead of them. If a driver fails to slow down to avoid hitting a pedestrian, this could form the basis of a negligence claim. There are a number of steps that should be taken after any accident.
- Eyewitnesses should be interviewed.
- Medical records should be preserved.
- Surveillance footage should be sought.
- The police report for the crash should be examined.
Most pedestrian collisions are completely preventable. It can be hard to know where to begin after a fatal collision. However, it is important for the victims of traffic accidents to understand that they do have rights. The family of any person who died in a car accident may have legal recourse through a civil claim. A pedestrian accident attorney can examine the unique facts of your case free of charge and let you know what your legal options are.
