Liability In Brooklyn Truck Accidents
Pedestrians have a naturally small profile and are more vulnerable to the hazards posed by passenger vehicles and trucks. According to one report from the Insurance Institute for Highway Safety (IIHS), “A total of 4,119 people died in large truck crashes in 2019. Sixteen percent of these deaths were truck occupants, 67 percent were occupants of cars and other passenger vehicles, and 15 percent were pedestrians, bicyclists or motorcyclists. The number of people who died in large truck crashes was 31 percent higher in 2019 than in 2009.” There are a number of ways that commercial trucks can be particularly dangerous to pedestrians.
- Commercial trucks tend to have large blind spots that can obscure the presence of pedestrians in the roadway.
- Commercial trucks take much longer to stop than passenger vehicles.
- Commercial truck drivers must work long hours and often become dangerously fatigued.
Depending on the facts of any case, a bus driver or truck driver could potentially be liable for a collision. Bus drivers are not supposed to drop off passengers in the middle of the road. This is dangerous and could easily contribute to a collision. A truck driver could also be liable if they hit a pedestrian. Pursuant to New York Vehicle & Traffic Law § 1146(a), all drivers must exercise due care to avoid hitting pedestrians. Victims of truck accidents tend to suffer very serious and costly injuries including:
- Broken bones
- Head injuries
- Spinal cord injuries
The FMCSA requires commercial trucks to carry between $750,000 – $5,000,000 worth of liability coverage. Any person that is injured may be able to seek aid through a bodily injury claim. Damages in a civil claim can help cover lost wages, medical bills and pain and suffering. A New York City truck accident attorney can examine all of the facts of your case and let you know what your legal options are.
