Liability for New York City Pedestrian Accidents
Pedestrians are relatively small and more likely to be overlooked by drivers. According to the Governors Highway Safety Association, “Drivers hit and killed 3,304 people walking in the United States in the first half of 2024, down 2.6% from the year before but a staggering 48% above a decade ago, according to a new analysis from GHSA.” There are many different causes of pedestrian accidents.
- A large portion of pedestrian accidents involve drivers who are speeding.
- Many pedestrian accidents involve intoxicated drivers.
- Pedestrian collisions are more likely to happen at intersections as drivers are making a left turn.
Every driver in New York City has a legal obligation to continuously scan the road ahead of them and exercise the proper precaution necessary to safely navigate the roadways. Drivers must be particularly cautious around pedestrians and cyclists. If a driver fails to slow down to avoid colliding with any pedestrian in the roadway, they could be held liable through a civil claim. Several steps should be taken after any pedestrian accident.
- Fragments of any vehicle involved in a hit-and-run collision should be sought.
- Victims should seek a medical evaluation as soon as possible.
- An experienced pedestrian accident attorney should be contacted.
Most pedestrian accidents can be avoided when drivers are using proper precautions. But in far too many situations, drivers are more concerned with getting to their destination as fast as possible than simply operating their vehicle safely. Any person that is injured in a pedestrian collision may be able to seek some measure of accountability through a civil claim. The same principle extends to the family member of any pedestrian who dies. They are able to hold the negligent driver accountable through a wrongful death claim.
